The Port of Hamburg is the logistics centre for the North of Germany and as such one of the supports for economic growth.
Our job is to ensure maximum efficiency, safety and economy in all areas of the port infrastructure. The processes necessary for this are supported by optimised IT and communications technologies.
Committed and future-orientated thinking and trading are the foundation for our day-to-day work: Our aim is not only to provide the conditions for a growing port, rather to actively promote and shape this development. That is the aim of the HPA – this is where all of our efforts come together.

As the responsible institution under public law, we are the point of contact for all questions concerning marine and land-based infrastructure, the safety of shipping traffic, the port railway facilities, property management and the economic development of the port.
Our aim is to promote the locating of industry branches and value added logistics in the port area in order to provide a consistent, long-term increase in value creation in the Port of Hamburg.

Hamburg is Europe's traditional Asia port, but also the gate to Central and Eastern Europe and of course to Scandinavia.
From this position we are seizing our opportunities to further increase port turnover. Here, its not just a question of increased trade with the growth regions, we're also part of a tight regional network. Transparency is one of the most important principles of our corporate activities. We operate according to the Hamburg Corporate Governance Code (HCGC) and have, amongst other things, set up an internal corruption prevention committee, which helps us to detect bribery or the granting of unlawful advantage early on and then prevent it.

This applies both to our CO2 footprint and our sustainable management of traffic and energy. Stamping out corruption

Corruption occurs in many different forms. Alongside bribery and granting of unlawful advantage, a whole series of other aspects are covered by this term.

Typical of this is primarily the abuse of a function or position within a company or authority for personal gain. Corruption is a problem for the whole economy. It undermines trust in the integrity and operation of companies and causes considerable damage. This is why at the Hamburg Port Authority (HPA), corruption prevention is a permanent task, both for the Management Board and for each individual employee.

To this end, the HPA has set up a corruption prevention committee. The director of the Services Division and the directors of the Law and Committees, Internal Audit, Central Purchasing and Personnel business units are here responsible for preparing guidelines and developing measures to detect and prevent corruption. Here the committee adopts a zero-tolerance strategy. Clear guidelines and a code of practice should also contribute to all concerned having a clear awareness of where corruption starts in everyday working practice.

Thus, for example, the HPA has developed an internal control system. The internal control system contains various measures and rules for avoiding corruption. Amongst other things this includes the introduction of a "tip-off" management system:

The anti-corruption office acts as a point of contact, should irregularities or infringements against internal codes of practice or guidelines be observed or suspected.

External service providers, suppliers or business partners can also, in cases of suspicion, contact the HPA.

The following pages contain answers to all of the most important questions concerning corruption prevention.

The ombudsman receives tip-offs where there are suspected infringements against laws or internal codes of practice. He informs the informer about their rights and the further procedure. After a legal and factual assessment, the ombudsman forwards the tip-off to his contact at the HPA. The ombudsman can be involved as a person of trust in the process. He is at all times available to the informer as a point of contact.

All employees and external parties, such as suppliers or tender participants, can contact the ombudsman.

The word ombudsman is of Scandinavian origin and essentially means "mediator". The HPA understands the ombudsman to be an independent person of trust.

The ombudsman accepts tip-offs in respect of legal infringements. The aim is clarification and prevention of economic offences, balance sheet infringements and large asset misappropriations. First and foremost tip-offs in respect of corruption offences are wanted. Tender participants, in particular, can report any observed or suspected irregularities during tenders.

The term corruption is derived from the Latin word corrumpere = corrupt, subvert, bribe. There is no general definition for corruption. Typical of corrupt practices are primarily the abuse of a function or in particular an employee position as well as the demanding and seeking of personal advantages while simultaneously covering up this approach.

Corruption in the narrowest sense includes bribery and granting of unlawful advantage. This includes, according to German law, the bribing of voters and members of parliament, venality and pay-offs in commercial dealings as well as bribery, venality and granting of favours in connection with public officials. In the wider sense corruption also includes accompanying offences. This is taken to mean crimes directly related to corruption offences such as fraud and embezzlement offences, forgery, bid-rigging, obstruction of punishment, false certification in office, violation of the official secrecy act and violations against supplementary criminal statutes. Amongst the supplementary criminal statues are primarily the relevant sections of the data protection laws and the German Commercial Code.

Yes. The informer alone decides which information they give to the ombudsman and which information the ombudsman shall give to the HPA in the second step. Only in the case of incorrect use, i.e. provision of deliberately incorrect tip-offs is the ombudsman authorised to forward information to the HPA against the will of the informer. The ombudsman makes this clear upon first contact.

No, everyone may use the ombudsman free of charge.

Yes, sources can also contact the ombudsman anonymously. This applies right from the first contact with the ombudsman. If desired, the ombudsman then preserves the anonymity of the informer against the HPA.

The tip-off is followed up, while observing the law and the internal regulations as well as under due consideration of the claims of all the participants. In addition, the ombudsman forwards the tip-off after prior checking to his contact within the HPA.

The informer can find out at any time about the current state of progress. The informer is, at the latest, informed about the result of the process upon its completion within the framework of the legal permissions.

No, no independent legal relationship comes into existence between the informer and the ombudsman. Therefore, the ombudsman cannot and may not instigate any steps to enforce the individual rights or claims of the informer.

Yes. The ombudsman acts as a self-employed and independent lawyer and is not subject to any instructions from the HPA in respect of the content of his actions. The ombudsman decides, based on his own dutiful examination, whether and to what extent he may forward the facts of a case to the HPA.

The first contact can be made by phone, email, text message, general post or by way of a personal consultation.

Yes. Each employee's supervisor, anti-corruption officer and the management board can be contacted by the employee in this context.

Yes. The informer is protected. Any retaliation action against the informer will not be tolerated.

In spite of repeatedly voiced scepticism, cases of denunciation in the appointment of an ombudsman are very rare. Nevertheless, the ombudsman informs the informer at the start of the consultation that an abuse of the tip-off management system will not be tolerated and that the ombudsman is obliged, in the case of intentional abuse, to inform the HPA of the personal details of the informer. In all cases, employees are liable to disciplinary actions in the event of intentional abuse of the tip-off management system.

The ombudsman ensures compliance with legal obligations and the data protection conditions. Collected personal data is limited to information regarding the identity of the informer and the person(s) concerned. The data protection officer of the HPA periodically checks the data protection conformity of tip-off management.

No. Presumption of innocence applies. Every tip-off is followed up, while observing the law and the internal regulations as well as under consideration of the claims of all the participants. Only upon completion of the process are decisions made about possible measures.

Insofar as it was submitted in good faith, i.e. it was not intentionally false, then the informer need not fear any consequences.

No, usage of the ombudsman is voluntary. It has been set up to provide an additional contact point.

Yes, the ombudsman is also available to external parties, such as suppliers or tender participants.

Yes. It is always possible to visit the ombudsman personally in order to have a private consultation.

Yes, travel costs are reimbursed by the company. Processing is undertaken by the ombudsman so that here also anonymity is, where necessary, maintained.

Yes. The informer is, at the latest, informed about the result of the process upon its completion within the framework of the legal permissions.

No. If the ombudsman is called as a witness in a criminal, civil or other case, he may only reveal the name and identity of the informer if this has been expressly authorised to him both by the HPA and also the informer; this authorisation having been given in writing.

Yes. The ombudsman can in the first instance be contacted in a completely confidential manner. The ombudsman informs the informer of their rights at the start of the consultation. Only at the end of the consultation does the informer decide whether and in what form the information is to be forwarded to the HPA.

The ombudsman can also be contacted if the informer has made himself liable to prosecution. Firstly, the ombudsman can inform the informer about his rights. Secondly, a self-denunciation will be viewed positively within the scope of the existing work relationship and may have a mitigating effect in any possible future legal proceedin

No. Only in narrowly defined exceptional cases, where really serious crimes have been committed, everyone has a duty to disclose the tip-off about a crime to a public prosecutor.

In this case the ombudsman can contact the HPA management board directly.

There is no general answer. Some tip-offs can be processed within a few hours. Where extensive investigations are concerned, processing may take several weeks.

We act responsibly

The Hamburg Port Authority introduces environmental guidelines because it is very aware of the area of conflict between port and environment. The aim of the guidelines is to protect and care for natural resources. Moreover, sustainable development must be promoted and environmental protection be firmly positioned in our thinking and approach.

The HPA basis for any environmental management is the binding specification of an environmental policy. The HPA recognises its responsibility for environmental protection explicitly by way of environmental guidelines. The reduction of emissions and consumption, avoidance of waste, increases in efficiency and the improvement of environmental performance are essential corporate goals.

Hamburg Port Authority and its employees are extremely aware of the relationship between the port and the environment. In accordance with our mission to operate, expand and develop the port of Hamburg, we aim to meet the needs and wishes of our customers and users, while being careful to ensure that adverse effects on the quality of life and the environment in the port of Hamburg and its environs are avoided wherever possible.
